• Failure to Make Timely Payments: If a Member fails to pay any charges owed to AtelierDIX LLC by the specified due date.

• Legal and Financial Troubles: In cases where a Member faces legal actions such as seizure, provisional seizure, provisional disposition, compulsory execution, bankruptcy, or is in a state of civil rehabilitation.

• Incorrect Password Entries: If a Member repeatedly enters an incorrect password more than the allowed number of attempts as set by AtelierDIX LLC.

• Inactivity: Should a Member not utilize the Service within a timeframe determined by AtelierDIX LLC.

• Violation of Terms: If a Member breaches any of the Terms of Service or any other specific agreements made with AtelierDIX LLC.

• Disqualification as Determined by AtelierDIX LLC: If AtelierDIX LLC deems a Member to no longer qualify for the services offered, based on conduct or other relevant factors.

• Order Placement and Processing: Members can place orders through our platform, where we handle the procurement and processing of these orders with Japanese merchants.

• Payment Processing: We offer various secure payment options for international transactions, ensuring a smooth purchasing experience.

• Customer Support: Our dedicated team provides assistance in multiple languages for inquiries, order status updates, and after-sales support.

• Additional Services: We offer value-added services such as package consolidation, gift wrapping, and special requests handling.

 

 

10. Product Purchase

Proxy Purchase Request: Members must request a proxy purchase of products according to the procedures established by AtelierDIX LLC.

Member-Exclusive Service: Only registered Members are entitled to request our proxy purchasing services.

Purchase Process: AtelierDIX LLC will conduct the purchase on the Member's behalf, following confirmation of the Member's purchase application.

Cancellation Policy: Once a Member has requested a proxy purchase, cancellation is generally not permitted unless explicitly approved by AtelierDIX LLC.

Request Approval: AtelierDIX LLC reserves the right to accept or reject any Member's purchase request at its discretion.

Points from Sellers: If a purchase accrues redeemable points from the seller, these points shall remain with AtelierDIX LLC.

Transfer of Ownership: Ownership of the purchased products is considered transferred to the Member when AtelierDIX LLC dispatches the products.

Financial Responsibilities: Members are responsible for all costs associated with the purchase and delivery of products. This includes, but is not limited to, delivery charges from the seller to AtelierDIX LLC, transaction fees, applicable Japanese taxes, custom duties at the destination, service charges, and international shipping costs. Service Charges: Members must pay the service charge indicated at the time of the proxy purchase request. AtelierDIX LLC may modify service charges without prior notice.

Product Unavailability: If AtelierDIX LLC cannot purchase a requested product due to its unavailability, the company will adjust the member's charges accordingly. For auction items, if the final bid exceeds the pre-set limit, the Member is liable for the higher cost.

Payment Terms: Members must pay the total cost as stipulated by AtelierDIX LLC by the specified due date.

Late Payment Penalty: Members failing to pay on time will incur a late payment fee of 14.6% per annum on the outstanding amount.

Rights Transfer Prohibition: Members are not permitted to transfer, pledge, or dispose of any rights under the contract with AtelierDIX LLC to third parties.

Non-Payment and Contract Cancellation: If a Member fails to pay the stipulated price by the due date, AtelierDIX LLC may cancel the contract without notice and seek compensation for any resultant losses.

No Refunds After Cancellation: If AtelierDIX LLC cancels a contract post-purchase, refunds of the product price to the Member are not applicable.

Members are generally not permitted to cancel this request unless AtelierDIX LLC agrees to the cancellation. This restriction applies both before and after the contract's execution.

15. Refusal to Provide Service AtelierDIX LLC may refuse to provide service in the following scenarios:

• The Member fails to pay the purchase cost.

• Significant errors are identified in the purchase cost or sale conditions.

• Difficulty in acquiring the requested product is anticipated.

• The Member fails to pay the product price by the specified date.

• The Member does not receive the product by the nominated date.

• Violation of the Terms of Service by the Member.

16. Disposal of Unclaimed Products

Company's Discretionary Disposal: AtelierDIX LLC may sell, discard, return, or otherwise dispose of products under the conditions listed in item 11 or if the situations described in item 15 arise.

Holding Period for Unclaimed Products: Products that fall under the scenarios of Article 15, except for specific instances, will be retained by AtelierDIX LLC for 30 days from the date of receipt.

Member's Directive on Unclaimed Products: If a Member resolves the issues outlined in item 15 within the 30-day holding period, they may instruct AtelierDIX LLC to dispatch the products to a specified address or forward them as per an agreed method.

Disposal of Products upon Unresolved Issues: Should the Member fail to address the issues listed in item 15 within the stipulated timeframe, AtelierDIX LLC reserves the right to sell or dispose of these products.

No Liability for Losses: AtelierDIX LLC will not be responsible for any losses incurred by the Member as a result of disposing of products under these terms.

Legal Compliance: Notwithstanding these stipulations, AtelierDIX LLC may undertake procedures as per the Civil Execution Act.

17. Modification and Abolition of Service Details

Lack of essential services from telecommunications providers.

No Liability for Suspension or Discontinuation: AtelierDIX LLC will not be responsible for any losses suffered by Members as a result of the temporary suspension or discontinuation of its services.

22. Governing Law and Agreed Jurisdiction

• Applicability of Japanese Law: The Terms of Service and any separate agreements are governed by and construed in accordance with the laws of Japan.
